3. Order, Conclusion of the Contract and Payment Terms

The travel agency offers packages in two basic ways: as pre-arranged packages available on the website and as individually tailored packages prepared according to the customer’s requirements.

3.1 Pre-arranged Package

For a pre-arranged package, the product page contains the main information about the package, in particular the travel dates, destination, duration of the trip, number of nights, scope of included services, transport, accommodation, ticket category, total price, payment terms, cancellation terms and any special conditions of participation.

Before completing the order, the customer is provided with the essential information about the package, the Terms and Conditions, the Pre-contractual Information for Package Travel and the Information on Insolvency Protection Insurance of the travel agency.

For a pre-arranged package, the package travel contract is concluded by completing the order process on the travel agency’s website, i.e. by the customer actively confirming the order by clicking a button marked as an order with an obligation to pay or by another similarly clear method.

After the package travel contract has been concluded, the customer is requested to pay the package price. The package price is payable in full, unless otherwise stated for the specific package or in the order confirmation.

Payment is made by bank transfer to the travel agency’s bank account stated in the order confirmation, through the payment gateway on the travel agency’s website, or by another payment method specified for the particular package.

After the contract has been concluded and payment has been received, the customer may be asked to provide the data necessary for the performance of individual services, in particular for the issuance of tickets, arrangement of accommodation, transport or other agreed services.

3.2 Individually Tailored Package

For an individually tailored package, the customer first submits their requirements to the travel agency through a configurator, enquiry form, e-mail or other communication channel, for example the destination, selected match, requested ticket category, type of accommodation, transport and other additional services.

Submitting an enquiry by the customer does not constitute the conclusion of a package travel contract and does not create any obligation for the customer to pay for the package.

Based on the customer’s requirements, the travel agency prepares an individual offer. This offer contains the specific parameters of the proposed package, in particular the travel dates, destination, selected match, scope of included services, type of accommodation and transport, total price, payment terms, cancellation terms, validity period of the offer and other essential information before the conclusion of the package travel contract.

If the customer does not agree with the individual offer, the customer is not obliged to accept it and may reject it or request its modification.

For an individually tailored package, the package travel contract is concluded only when the customer expressly accepts the individual offer. Acceptance of the offer is made by an active and provable action of the customer, in particular by clicking a confirmation button marked “I agree with the offer – order with obligation to pay”, by confirming the offer by e-mail or by another similarly clear electronic confirmation.

Only after the individual offer has been accepted and the package travel contract has been concluded is the customer requested to pay the package price or provided with payment instructions.

After the contract has been concluded and payment has been received, the travel agency will begin taking the steps necessary to arrange the agreed services, in particular the purchase of tickets, reservation of accommodation, transport and other services included in the package.

If the customer fails to pay the package price duly and on time within the specified deadline, the travel agency is entitled to cancel the order or reservation. This is without prejudice to the travel agency’s right to reimbursement of any costs already incurred, where provided for by the Terms and Conditions or applicable law.

4. Customer’s Withdrawal from the Contract and Cancellation Terms

The customer is entitled to withdraw from the package travel contract before the start of the package. In such a case, the travel agency is entitled to charge a reasonable cancellation fee, the amount of which depends on the time at which the customer withdraws from the contract and on the costs already incurred or expected in connection with arranging the package.

Unless otherwise stated for the specific package, the following cancellation fees apply:

Time of withdrawal before the start of the package

Cancellation fee

more than 45 days

10% of the total package price

44–30 days

30% of the total package price

29–15 days

50% of the total package price

14–7 days

75% of the total package price

6 days or less, including no-show

100% of the total package price

The withdrawal from the contract must be delivered to the travel agency in text form, in particular by e-mail to info@90plustickets.com. The date on which the withdrawal is delivered to the travel agency is decisive for determining the amount of the cancellation fee.

This is without prejudice to the customer’s right to withdraw from the package travel contract without paying a cancellation fee in cases provided for by applicable law, in particular if, before the start of the package, the travel agency proposes a substantial change to one of the main characteristics of the package and the customer does not agree with such change.

If the package includes services that are non-refundable, non-transferable or linked to a specific person, in particular personalised tickets, flight tickets or other services provided by third parties, the costs associated with such services may be taken into account when calculating the cancellation fee in accordance with the Terms and Conditions and the terms of the relevant service providers.

5. Special Provisions on Personalised Tickets

Some packages may include a personalised ticket for a sports or cultural event, in particular a ticket issued in the name of a specific person or a ticket linked to a specific customer account, membership or other customer identification.

The customer acknowledges that the conditions for changing, transferring or cancelling such a ticket are governed in particular by the rules of the event organiser, club, stadium, ticketing platform or other ticket provider.

If a personalised ticket has already been issued, purchased or otherwise arranged for a specific customer and, under the rules of the relevant provider, cannot be cancelled, changed or transferred to another person, the price of such ticket may be non-refundable if the customer withdraws from the contract.

In such a case, the amount corresponding to the price of the personalised ticket may be included in the cancellation fee regardless of the time at which the customer withdraws from the contract. The remaining part of the package price, in particular accommodation, transport or other services, is governed by the cancellation terms set out in this pre-contractual information, in the Terms and Conditions or for the specific package.

The customer is informed of any non-refundable, non-transferable or limited-transfer nature of a personalised ticket in the package offer, on the product page of the specific package and/or in the order confirmation.

6. Transfer of the Package Travel Contract to Another Person

Before the start of the package, the customer may transfer the package travel contract to another person, provided that such person meets all conditions for participation in the package.

The transfer of the contract is effective towards the travel agency if the customer delivers a notice of the transfer to the travel agency in text form, together with a statement from the new person confirming that they agree with the concluded contract and meet the conditions for participation in the package.

The notice of transfer is considered timely if it is delivered to the travel agency at least 7 days before the start of the package.

The original customer and the new customer are jointly and severally liable for payment of the package price and for reimbursement of reasonable and actually incurred additional costs associated with the transfer of the contract, in particular fees charged by the carrier, accommodation provider, event organiser, ticketing platform or another service provider.

If the package includes services linked to a specific person, in particular personalised tickets, flight tickets or other non-transferable services, the transfer of the contract may be restricted or factually impossible under the rules of the relevant service provider. The customer is informed of such restriction for the specific package, in the offer and/or in the order confirmation.

7. Restrictions on Transfer in the Case of Personalised and Non-transferable Services

For packages that include a personalised ticket, flight ticket, accommodation, membership, customer account or another service linked to a specific person, the transfer of the package travel contract to another person may be restricted or factually impossible.

Such restriction may arise in particular from the rules of the event organiser, club, stadium, carrier, accommodation provider, ticketing platform or another service provider.

If transferring the contract to another person would make it impossible to provide any of the agreed services, in particular due to the inability to change the name, customer account or other identification, the transfer of the contract may not be possible to that extent.

The customer acknowledges that an attempt to use a personalised or non-transferable service by another person may result in refusal of entry to the event, refusal of transport, refusal of accommodation or non-provision of another service by the relevant provider.

Information about any non-transferable nature, limited transferability or special conditions of personalised services is provided for the specific package, in the offer and/or in the order confirmation.

8. Minimum Number of Participants

Some packages may be subject to a minimum number of participants. If a minimum number of participants is set for a specific package, it is always stated on the product page of the specific package, in the individual offer and/or in the order confirmation.

If the required minimum number of participants is not reached, the travel agency is entitled to cancel the package within the period stated for the specific package, in the individual offer and/or in the order confirmation, always in accordance with applicable law.

If the package is cancelled due to the minimum number of participants not being reached, the travel agency will refund all payments received from the customer for the package in full and without undue delay.

If no minimum number of participants is expressly stated for a specific package, the package is deemed not to be conditional upon reaching a minimum number of participants.

9. Travel Documents, Entry Requirements and Event Entry Rules

The customer is required to have a valid identity card, passport or other travel document required for entry into the destination country and for return travel throughout the package. If required by the destination or transit country, the customer is also responsible for obtaining a visa, vaccination, health certificate or any other required documents.

Before the start of the package, the customer is responsible for verifying the current entry, residence, transit, health and other administrative requirements applicable to them, in particular with regard to their nationality, age, health condition and travel route.

The travel agency provides the customer with general information on travel documents and entry requirements where relevant for the package and known to the travel agency. However, such information does not replace the customer’s individual verification of the requirements with the competent authorities, embassies or consulates, carriers or event organisers.

The customer is also required to comply with the rules of the organiser of the sports or cultural event, stadium rules, safety instructions, rules for home and away supporters, ticket usage rules and any restrictions stated for the specific package, in the offer or in the order confirmation.

The travel agency is not liable if the customer is denied entry into the destination country, a transit country, a means of transport, accommodation facility or a sports or cultural event due to missing, invalid or incorrect customer documents, failure to meet entry requirements, breach of the rules of the event organiser, stadium, carrier or another service provider, or due to incorrect information provided by the customer.

10. Customer Rights under Package Travel Legislation

Packages organised by the travel agency are subject to customer rights under Directive (EU) 2015/2302 of the European Parliament and of the Council on package travel and linked travel arrangements, Act No. 159/1999 Coll. and the relevant provisions of Act No. 89/2012 Coll., the Civil Code, in particular the provisions governing package travel.

The customer has, in particular, the right to receive clear and comprehensible information before concluding the package travel contract, the right to the proper performance of the agreed travel services, the right to assistance in difficulty during the package, the right to report defects in the package, and the right to protection in the event of the travel agency’s insolvency.

The travel agency is responsible to the customer for the proper performance of all travel services included in the package travel contract, even where individual services are actually provided by third parties, such as carriers, accommodation providers, event organisers or other service providers.

A more detailed regulation of the rights and obligations of the customer and the travel agency is set out in the Terms and Conditions for Package Travel, in this pre-contractual information, for the specific package and in the order confirmation.

A summary of travellers’ rights under package travel legislation is also available on the official website of the Ministry of Regional Development of the Czech Republic.

11. Contact Point for Assistance during the Package

In the event of any difficulties during the package, the customer may contact the travel agency using the following contact details:

E-mail: info@90plustickets.com
Phone: +420 774 051 061

The customer is required to notify the travel agency of any difficulties, defects in the package or other circumstances requiring assistance without undue delay after becoming aware of them, so that the travel agency can take appropriate remedial measures.

The travel agency will provide the customer in difficulty with appropriate assistance in accordance with Section 2527 of Act No. 89/2012 Coll., the Civil Code. Depending on the nature of the situation, such assistance may include in particular providing the necessary information, assistance with communication with service providers, carriers, accommodation providers, event organisers or other relevant parties.

This is without prejudice to the customer’s rights arising from the travel agency’s responsibility for the proper performance of the services included in the package travel contract.

Specific information about each individual package stated on the product page, in the individual offer, in the order confirmation or in the package travel contract shall prevail over the general information contained in this document if there is any difference between them.

The rights and obligations of the customer and the travel agency are further governed by the travel agency’s Terms and Conditions, the package travel contract, Act No. 159/1999 Coll., Act No. 89/2012 Coll., the Civil Code, and other applicable laws of the Czech Republic.
